Outils Océans, mindful of individuals’ rights, particularly with regard to automated processing, and committed to transparency with its clients, has implemented a privacy policy to allow them to best exercise their rights. Definitions
Client: any professional or natural person with legal capacity within the meaning of Articles 1123 et seq. of the French Civil Code, or any legal entity visiting the Site.
User: Internet user connecting to and using the Site.
Personal data: refers to any information allowing the direct or indirect identification of a natural person.
Data controller: refers to the legal entity that determines the purposes and means of processing personal data collected.

2. General Terms of Use of the Site (ToU)
Use of the Site implies full and complete acceptance of the general terms of use described below. These terms may be modified or supplemented at any time; users of the Site are therefore invited to consult them regularly.
The Site is normally accessible at all times to Users. An interruption for technical maintenance may, however, be decided by Outils Océans, which will then make every effort to inform users in advance of the dates and times of the intervention. The Site is updated regularly.
3. Description of Services Provided
The purpose of the Site is to provide information concerning all of the company’s activities. Outils Océans strives to provide information on the Site that is as accurate as possible.
However, it cannot be held responsible for omissions, inaccuracies, or failures to update, whether caused by its own actions or by third-party partners providing such information.
All information on the Site is given for guidance only and may change. Furthermore, the information appearing on the Site is not exhaustive and is provided subject to modifications made since it was put online.
4. Contractual Limitations on Technical Data
The Site uses WordPress/Prestashop technology. The Site cannot be held responsible for material damage resulting from its use. In addition, the user agrees to access the Site using recent, virus-free equipment and an updated, latest-generation browser.
The aim is to provide a service ensuring the best possible accessibility rate. The host ensures continuity of service 24/7, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible durations, particularly for maintenance, infrastructure improvements, infrastructure failures, or if the services generate traffic deemed abnormal.
Outils Océans and the host cannot be held liable in the event of malfunction of the Internet network, telephone lines, or IT and telecommunications equipment, particularly due to network congestion preventing access to the server.
5. Intellectual Property and Counterfeiting
Outils Océans owns the intellectual property rights and holds the rights of use over all elements accessible on the Site, notably texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the Site’s elements, regardless of the means or process used, is prohibited without prior written authorization.
Any unauthorized use of the Site or of any of its elements will be considered counterfeiting and prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitations of Liability
Outils Océans acts as the publisher of the Site.
Outils Océans cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing the Site and resulting either from the use of equipment not meeting the specifications mentioned in point 4 or from the appearance of a bug or incompatibility.
Outils Océans also cannot be held liable for indirect damage (such as loss of business or loss of opportunity) resulting from the use of the Site. Interactive spaces (possibility to ask questions in the contact area) are available to users. Outils Océans reserves the right to delete, without prior notice, any content posted in this space that would violate applicable French legislation, in particular data protection provisions. If necessary, Outils Océans also reserves the right to hold the user civilly and/or criminally liable, notably in the event of racist, insulting, defamatory, or pornographic messages, regardless of the medium used (text, photographs, etc.).
7. Processing of Personal Data
7.1 Data Controllers
As the data controller, Outils Océans undertakes to comply with the legal requirements in force. It must in particular define the purposes of its data processing, provide its prospects and clients with complete information regarding the processing of their personal data upon collection of their consent, and maintain a processing register that reflects reality. Whenever Outils Océans processes Personal Data, it takes all reasonable measures to ensure the accuracy and relevance of the Personal Data concerning the purposes for which Outils Océans processes them.
7.2 Data Collected
Personal information that may be collected on the Site is primarily used by Outils Océans for managing relationships with its Users and, where applicable, for processing orders.

7.3 Purposes of Data Processing
Data collected through the use of the Site and access to its resources is processed to enable access to published resources, identify users, improve services, and distribute editorial content as well as conduct commercial prospecting operations.
Information collected via forms is used for the following purposes:

Outils Océans processes data only if at least one of the following conditions is met:

Recipients of user data include:

marketing, sales, and administrative teams for managing client, prospect, and partner relationships. The marketing team uses the BREVO platform to automate marketing actions and manage content publication.

Data retention periods applied by Outils Océans are proportionate to the purposes for which they were collected. Outils Océans therefore organizes its data retention policy to keep data only for the strictly necessary duration.
Personal data collected for business and/or marketing purposes is retained for 3 years from collection by the publisher or from the last contact initiated by the User.
7.4 Right of Access, Rectification, and Objection
In accordance with current European regulations, Users of the Outils Océans site have the following rights:

right of access (Article 15 GDPR), rectification (Article 16 GDPR), updating, and completion of User data; right to block or delete personal data (Article 17 GDPR) when inaccurate, incomplete, ambiguous, outdated, or collected, used, communicated, or stored unlawfully;

7.5 Non-Communication of Personal Data
Outils Océans undertakes not to process, host, or transfer the information collected from its Clients to a country outside the European Union or not recognized as “adequate” by the European Commission without prior notice to the client. However, Outils Océans remains free to choose its technical and commercial subcontractors, provided they offer sufficient guarantees under the GDPR.
Outils Océans undertakes to take all necessary precautions to preserve the security of the information and prevent it from being disclosed to unauthorized parties. If an incident affecting the integrity or confidentiality of Client Information is detected, Outils Océans will inform the client as soon as possible and communicate corrective measures. Furthermore, Outils Océans does not collect any “sensitive data.”
Personal Data may be processed by Outils Océans subsidiaries and subcontractors solely to fulfill the purposes of this policy.
Within their respective responsibilities and for the purposes listed above, the main individuals likely to access User data are Outils Océans employees.
8. Incident Notification
Despite all efforts made, no transmission or electronic storage method is completely secure. Therefore, absolute security cannot be guaranteed. If we become aware of a security breach, affected users will be notified so they can take appropriate measures. Our incident notification procedures take into account our legal obligations at national and European levels. We commit to fully informing our clients of any issues relevant to the security of their account and providing all necessary information to help them meet their regulatory reporting obligations.
No personal information of the Outils Océans site user is published, exchanged, transferred, assigned, or sold to third parties without the user’s knowledge. Only the acquisition of Outils Océans and its rights would permit the transfer of such information to the potential buyer, who would in turn be bound by the same obligations regarding the conservation and modification of data toward the user.
8.1 Security
To ensure the security and confidentiality of Personal Data, Outils Océans uses networks protected by standard devices such as firewalls, pseudonymization, encryption, and passwords.
During the processing of Personal Data, Outils Océans takes all reasonable measures to protect them from loss, misuse, unauthorized access, disclosure, alteration, or destruction.
8.2 Exercise of Rights
Any User has the right, in accordance with applicable regulations, to permanent access, modification, rectification, objection, and restriction of processing concerning their data.
This right may be exercised by contacting the above address by mail or email.
Any individual also has the right to lodge a complaint with the CNIL (French Data Protection Authority) at www.cnil.fr.
Outils Océans does not engage in telephone solicitation, but Clients are informed that they can register on the “Bloctel” do-not-call list.
9. Hyperlinks, “Cookies,” and Internet Tags
The Outils Océans site contains a number of hyperlinks to other websites, implemented with the authorization of Outils Océans. However, Outils Océans cannot verify the content of the sites visited and therefore assumes no responsibility.
Unless you choose to disable cookies, you consent to their use. You may disable cookies at any time free of charge using the options described below, bearing in mind that doing so may reduce or prevent access to some or all of the services offered by the Site.
9.1 Cookies
A “cookie” is a small information file sent to the User’s browser and stored on their device (e.g., computer, smartphone). This file contains information such as the User’s domain name, Internet service provider, operating system, and date and time of access. Cookies do not damage the User’s device in any way.
Outils Océans may process information regarding the User’s visit to the Site, such as pages consulted and searches performed. This information helps improve Site content and User navigation.

At any time, the User may modify their preferences regarding cookies. Outils Océans may also use external service providers to help collect and process the information described in this section.
Lastly, by clicking on social media icons (Facebook, LinkedIn, YouTube) on the Website or mobile application, and provided the User has consented to cookies, these platforms may also store cookies on their devices.
These cookies are only placed if the User consents, by continuing navigation. The User may withdraw consent at any time.
9.2 Internet Tags (“Web Beacons”)
Outils Océans may occasionally use Internet tags (also called “web beacons,” action tags, single-pixel GIFs, transparent GIFs, invisible GIFs) and deploy them through a web analytics partner located in a foreign country.
These tags may be placed both in online advertisements enabling users to access the Site and on its various pages.
This technology allows Outils Océans to evaluate visitor responses to the Site and the effectiveness of its actions (for example, number of page openings and content viewed), as well as User behavior on the Site.
The external provider may collect information on visitors to the Site and other websites thanks to these tags, compile reports on Site activity for Outils Océans, and provide related Internet usage services.
10. Applicable Law and Jurisdiction
Any dispute related to the use of the Outils Océans site is subject to French law. Except in cases where the law does not permit it, exclusive jurisdiction is granted to the competent courts of Quimper.
